The following changes to New Mexico Municipal Court Fees go into effect July1, 2024

As of July 1, 2024 your court can no longer assess the $29 state-mandated fees per charge that you currently assess.

For fees assessed prior to July 1, 2024, you can still collect the $29 fees, however defendants may petition your court to waive fees assessed on their cases(s).  Your Judge may also decide to waive any and all outstanding fees.

Any AOC/JEC fees collected on or after July 1, 2024 will continue to be sent monthly to AOC Santa Fe.

Any Corrections fees collected on or after July 1, 2024 – contact the New Mexico Department of Finance & Administration for details.

DWI Fees

As of July 1, 2024, you can no longer assess:

DWI Lab Fee $85 NM §31-12-7(A)

DWI Prevention Fee $75 NM §31-12-7(B),

DWI Substance Abuse Fee $75 NM §31-12-8(A),

Any DWI fees collected on or after July 1, 2024 will continue to be sent monthly to AOC Santa Fe.

These fees were repealed effective 7/1/2024 by House Bill 139 (2023) ELIMINATING COURT FEES. A copy of the legislation can be reviewed at:

For Home Rule/Charter municipalities – these changes do not affect any local court fees assessed or collected by your court.
